1. Acceptance of Terms

By accessing or using Authmosphere's authentication gateway services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Services

Authmosphere provides authentication gateway services that add a secure access layer to existing web applications including:

• Passkey and biometric authentication
• QR and NFC-linked token authentication
• WordPress admin protection via plugin
• Legacy application authentication wrapping
• Reverse proxy gateway services

3. Account Registration and Security

3.1 Account Creation

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Shared Secrets and API Keys

You are responsible for securely managing shared secrets, API keys, and configuration credentials. Unauthorized disclosure of these credentials may compromise your security and is your responsibility.

4. Acceptable Use Policy

You agree not to:

• Use the Services for any illegal purpose or in violation of any laws
• Attempt to bypass, disable, or interfere with security features
• Reverse engineer, decompile, or disassemble any portion of the Services
• Use the Services to transmit malware, viruses, or harmful code
• Overload or attempt to disrupt our servers or networks
• Share account credentials with unauthorized parties
• Engage in any activity that could harm Authmosphere or other users

5. Service Level and Availability

While we strive to provide reliable services, Authmosphere does not guarantee uninterrupted or error-free operation. We reserve the right to:

• Modify, suspend, or discontinue any part of the Services
• Perform scheduled maintenance with reasonable notice
• Implement emergency fixes or security patches
• Limit or restrict access to certain features

6. Payment and Billing

6.1 Fees

You agree to pay all fees associated with your use of the Services. Fees are subject to change with 30 days' notice. Failure to pay may result in service suspension or termination.

6.2 Refunds

Refund policies are determined on a case-by-case basis. Contact our support team for refund requests. Services rendered prior to cancellation are generally non-refundable.

7. Intellectual Property

All content, features, and functionality of the Services are owned by Authmosphere and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.

You retain ownership of your data and content. By using our Services, you grant us a license to process and store your data as necessary to provide the Services.

8. Data and Privacy

Your use of the Services is also governed by our Privacy Policy. We collect, use, and protect your information as described in that policy. You are responsible for complying with applicable data protection laws when using our Services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTHMOSPHERE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Warranties and Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure. You use the Services at your own risk.

11. Indemnification

You agree to indemnify and hold harmless Authmosphere and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Termination

Either party may terminate this agreement at any time:

• You: Cancel your account through our platform or by contacting support
• Us: Suspend or terminate your access for violation of these Terms, non-payment, or at our discretion with notice

Upon termination, your right to use the Services ceases immediately. Data retention after termination follows our Privacy Policy.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

14. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and Authmosphere
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• Waiver: Failure to enforce any provision does not waive our right to enforce it later
• Assignment: You may not assign these Terms without our consent; we may assign freely
• Force Majeure: Neither party is liable for delays due to circumstances beyond reasonable control
